Terms of service

Tally Tells is operated by Upforged LLC (“we”, “us”), [BUSINESS ADDRESS]. We make personalized storybooks that show your child as the hero of a classic fairy tale. These terms apply when you use our website, make a free preview, or order a book. By doing any of those, you agree to them, and before you pay we ask you to tick a box to confirm it.

Our Privacy policy and Biometric data notice explain how we handle personal information and photos, and form part of these terms.

You must be at least 18 years old. Only a parent or legal guardian may upload a photo of a child, and only of a child in their care. Gift-givers can start a gift without a photo, and we ask the child’s parent to add it. A gift-giver may add a photo they have the right to share, but we use it only after the child’s parent signs our consent.

Tally Tells is made for adults. It is not designed for children to use on their own.

We currently sell and ship to addresses in the United States only.

When you upload a photo, you confirm that:

• you are the child’s parent or legal guardian;
• you have the right to use the photo, and it shows only the child the book is for;
• you have read and signed our biometric consent before upload.

We use the photo only to check it and draw your child for your book, and we delete it within 72 hours of upload, or sooner when you approve the drawing, as set out in our Biometric data notice. We don’t use your photo to train AI. You keep all rights to your photos; you give us a limited permission to use them for this purpose only.

Previews are free and need no payment details. Our illustrations are made with the help of AI and checked by a person, so a drawing may sometimes miss. You can ask for another version of the character (up to 3 in total), or use a different photo.

After you order, we make every page and send you the finished book to review. Nothing is printed until you approve it. Until then you can change the name, dedication and other details. When you approve, you confirm the spelling, text and pictures are as you want them printed.

Prices are shown in US dollars and include shipping to US addresses. Prices include sales tax where applicable. If we make an obvious pricing mistake, we will tell you and let you cancel for a full refund before anything is printed.

Payments are processed securely by our payment provider. We never see or store your full card number.

You can cancel for a full refund any time before you approve your finished book and it goes to print. Use “Cancel for a full refund” on your order page, or write to hello@tallytells.com with your order number. For a gift, the person who paid can cancel.

When you pay, we set a ship-by date for your book (up to 2 days to make and check it, then up to 6 business days to print it, or 10 from mid-November to early January). If we can’t ship by that date, we’ll email you a new expected date and a link to cancel for a full refund. If you don’t cancel, we’ll keep going.

Each book is made just for your child, so once printing starts we can’t resell it. Instead of refunds, we offer free reprints under our promise below. This doesn’t affect any rights you have under the law.

If your book doesn’t match the preview you approved, has a print or binding fault, or arrives damaged or not at all, tell us within 30 days of delivery and we’ll print a new one free. Send us a photo. You don’t need to return the book. Details are on our Promise and Shipping & returns pages.

Our stories are retold in our own words from public-domain folk and fairy tales. The text, illustrations, designs and website belong to Tally Tells or our licensors.

The printed book is yours to keep, read, gift and share with family. You may share photos of it and the digital edition for personal, non-commercial use. Please don’t resell, mass-copy or use the illustrations commercially.

Please don’t:

• upload photos of anyone other than your own child, or images you don’t have the right to use;
• upload anything unlawful, hurtful, or sexual, or try to make us draw it;
• try to break, overload, or scrape the site, or get around its limits.

We may refuse or cancel an order (with a full refund) if we believe it breaks these rules.

We take care to make every book right, and our reprint promise is our main remedy if something goes wrong. To the extent the law allows, our total responsibility for any order is limited to the amount you paid for it, and we aren’t responsible for indirect losses.

Nothing in these terms limits rights you have that cannot be limited by law.

We may update these terms. The version shown when you place an order applies to that order. If you have a problem, please write to us first. A person can fix most things quickly.

These terms are governed by the laws of the State of [STATE] and applicable US federal law. This doesn’t take away any protection you have under the consumer laws of the state where you live.
